Nevada DOC Administrative Regulation 740 - Inmate Grievance Procedure

Nevada Department of Corrections Administrative Regulation 740, published on the NDOC site with a temporary effective date of November 20, 2018, sets out the three-level grievance process inmates must use for addressable claims, including personal property, property damage, disciplinary appeals, personal injuries and other tort or civil rights claims about conditions of confinement. Grievances go in locked boxes at each institution, forms are kept in housing units and the law library, and emergency grievances on Form DOC-1564 may be handed to any staff member and must be reviewed within 24 hours. An informal grievance (Form DOC-3091) must be filed within six months for property, personal injury, medical or tort claims under NRS 209.243, or within ten calendar days for other issues, with responses due in 45 calendar days and appeals filed within five calendar days of receiving each response. First Level uses Form DOC-3093 and Second Level Form DOC-3094. Inmates may file only one grievance per seven-day week, must state a loss or harm and a requested remedy, and compensation for property or tort claims is capped at $500. Sexual abuse grievances are referred to the Inspector General's Office, which must decide within 90 calendar days with a possible 70-day extension, and time limits are waived for sexual abuse allegations.
