Application for Post Conviction Relief, Form CIV-760 (Alaska)
Form CIV-760 is the Alaska Court System's official application for post-conviction relief from a conviction or sentence under Criminal Rule 35.1 and AS 12.72.010-.040. Part A asks for the original case number, sentencing court and judge, the date on the clerk's certificate of distribution, the sentence, whether the applicant appealed, and whether any earlier post-conviction application, sentence modification motion, habeas petition or coram nobis petition was filed. Part B requires the grounds under Criminal Rule 35.1(a) plus supporting facts and attached affidavits, records or other evidence. Part C is for applicants claiming indigency and requires form CR-206 Financial Statement, form CIV-670 prisoner filing fee exemption and a six-month certified prisoner account statement from the Department of Corrections. It warns that if the application is denied the court enters a judgment for part of the cost of appointed counsel, from $250 to $750 depending on the offense.
